Cancellation and Refund Policy:

NOTE OF ADMINISTRATIVE FEES FOR CANCELLATIONS:  ($15 minimum administrative fee or 15% of the order price - not to exceed $50 ).

Note About Our Service: in reading this policy keep in mind that though we provide the filing for registering your company, our service is  a legal filing information and legal forms service. 

It is not a filing service per se -  If you know what forms, how to fill the forms,  what gov't agency, and what fees are required to file you documents just have someone provide that service for you - we are not a courier  service - we are a legal filing information and legal forms service  that provides the additional free service of filing your documents after you hire us to find out  in which fashion, at which government agency, in what legal document form and what the  cost of filing is for filing your documents.

 

Our service of filing of the documents (i.e., the taking of the documents to be filed over the counter at the specific government agency ) is provided for free after you purchase our information and legal forms for filing and registering your business. In other words,  our main services consists in gathering information on how, where, and in what form the filing should be done.  The filing itself is a free service we provide when you purchase the information on how to file and the form that are required to file.  However, note that you have to purchase the information on how to file,  and the legal forms required to file before we can file your documents for free.

Cancellation Immediately After You Place Your order:

 

NOTE OF ADMINISTRATIVE FEES:  (you are liable for $15 minimum administrative fee or 15% of the order price - not to exceed $50 ). 

If you notify us before we begun work and before we file your papers, you are only liable for a minimum of $15 or 15% of the order price (not to exceed $50 ).   Normally, this time could be about 30 minutes after you place your order (we begin working almost immediately on your order by sending, emailing you the legal forms and filing information ( i.e., the service you paying us for)).

For example, if you ordered a Federal Tax id for $29.99, you will be liable for $15 because there is a minimum administrative fee for cancellations. However, if you ordered a corporation bundle for $399, the fee is 15% which would be around $60 dollars but because there is a maximum administrative fee of  $50, you will only be liable for $50. 

Cancellation After We Begun Work:

If you cancel after we begun work you will be liable for 50% of our service fee amount.  Note: if we have emailed you all the forms, we have begun  our service so you will be liable for 50% of the total price/ amount of the order.

Cancellation After We File Your Legal Documents:

No Cancellations or Refunds  After We Filed Your Fictitious Business Name Statement, Corporation, Tax Id, or Business License (see below for special business license / tax registration policy).

Note: there is no cancellation even if the state rejects the filing of you business name or tax id. 

Special Policy for Business License / Business Tax Registration Purchases -  

In the case that  we started working and  find out you don't need a business license / tax registration, you are still liable for the total amount of the business license order.  This is because our filing service concerning business license consists exactly of that - finding our whether you need a license and what taxes you have to pay.  The reason for that is that there are simply hundreds of cities and the fees and procedures change constantly and we have in each case to spend considerable time in finding the information about whether or not a  license is required.    The filing of that license is the easy part and we don't charge for it.  We charge you for finding out what license and what fee you need to pay to file.   However to get the free filing service, you need to purchase you information service.  That is why  we don't give refunds for Business License Orders. We work hard to find the information on whether or not you need a business license.   Sometimes it will take even days before we can get anyone on the phone to find out that information.  We don't work for free.   However, keep in mind, that normally this is not a problem because 99.9999 % of all business are required to register for paying taxes (tax registration / business license). 

Check bounces or credit card  declined: We Charge a $30  fee for NSF checks. 

IMPORTANT: PLEASE MAKE YOUR CANCELLATION IN WRITING. TELEPHONE CALLS ARE NOT SUFFICIENT FOR CANCELLATIONS.

XKR ESSEX, INC services are subject to the following Terms:

1. XKR ESSEX, INC is not engaged in rendering legal services.  Unless,  you purchase the option “ incorporation.”   This is a legal document information filing service.

2. XKR ESSEX, Ink's liability (in the aggregate) shall not exceed $5,000.00 . XKR ESSEX, Ink's entire liability and Customer's exclusive remedy for damages, whether in contract or in tort, shall be limited at maximum, to a refund of the fees paid by the Customer.

3. XKR ESSEX, INC shall not be liable to Customer or any third party for any direct, indirect, special, consequential, or incidental damages (including damages for loss of business profits, business interruption, loss of business information, and the like), arising out of the use of XKR ESSEX, Ink's services.

4. Client must contact XKR ESSEX, INC within the 14 calendar day to allow correction of  errors. No refunds or adjustments of service fees paid will be offered in the case of errors.

5. XKR ESSEX, INC  provides Clients with a service at a fixed service fee.   In the event any service or cost to us extends beyond the usual length of time, or  the  service requires additional costs, Client shall be billed at the published rate of $180.00.

6. For the resolution of  disputes between the Client and XKR ESSEX, INC relating to or arising out performance under our terms, you, the Client,  and XKR ESSEX, INC agree to submit to the  jurisdiction of the state courts or the United States District Court, located in the County of  Los Angeles, California, United States of America.
